Deck and Patio Maintenance
As outlined in the Association’s governing documents, decks and patios are considered part of the Common Areas; however, they are designated for the exclusive use of the individual homeowner associated with each unit. With that exclusive use comes important responsibilities.
Owner Responsibilities
Homeowners are responsible for the ongoing maintenance, repair, and overall appearance of their deck or patio. This includes addressing normal wear and tear, weather-related deterioration, structural issues, and ensuring the area remains safe and in good condition at all times. Routine upkeep such as cleaning, sealing, staining, and minor repairs should be performed regularly to extend the life of the structure. Costs associated with these repairs are the responsibility of the homeowner.
Repairs and Modifications
Before performing any repairs, replacements, or modifications to a deck or patio, homeowners must submit contractor plans, including material specifications, dimensions, and scope of work, to the Board and receive written approval. No work should begin without this approval.
All work must be completed by a licensed and insured contractor. Homeowners are responsible for ensuring that contractors comply with all applicable local building codes and permit requirements. Any damage to surrounding common elements during construction must be repaired at the homeowner’s expense.
The size of the deck must remain exactly as currently constructed. No enlargements or expansions are permitted.
For any oversized decks or patios:

Written Board approval is required for any repairs or modifications.

These structures must be returned to their original approved size upon transfer of ownership (sale, gift, etc.).

Owners may be required to provide documentation confirming prior approval of the existing structure.

To maintain a consistent appearance throughout the community, only approved stains and colors may be used.

When purchasing, please request the approved color by name (Chesapeake Chestnut or Chesapeake Brown) to ensure proper matching with community standards.
Insurance Requirements
Homeowners with decks—especially oversized or elevated structures—are required to maintain adequate insurance coverage at their own expense. Policies must meet Association requirements and include the Association as an additional insured. Proof of insurance may be requested periodically.
Association Role
While the Association maintains the right to repair and maintain Common Areas, including decks and patios, it may assess homeowners for costs related to these areas. Additionally, if repairs are necessitated by negligence, misuse, or failure to properly maintain, those costs may be charged back to the responsible owner.
In cases where a deck or patio is deemed unsafe or in disrepair, the Association reserves the right to require corrective action within a specified timeframe. If the homeowner does not address the issue, the Association may complete the work and bill the owner accordingly.
Compliance
All work must comply with Association rules and regulations. Unauthorized changes, use of unapproved materials, alterations in appearance, or failure to maintain structures may result in enforcement action, fines, or required corrective work.
